OPPOSITION LEADER SPENDS ANOTHER WEEKEND IN PRISON

ZIMBABWE'S main opposition leader, Mr. Morgan Tsvangirai spent another weekend in custody this time awaiting a High Court ruling on his bail application. Mr. Tsvanagirai, already being tried for treason, is facing fresh charges of virtually the same offense.

He was arrested last Friday on the latest allegations and appeared for initial remand before a magistrate's court early last week. He has since applied for bail at the High Court, arguing that the State's case against him is weak and therefore he should not be kept in custody. Justice Susan Mavangira on Friday reserved ruling on the matter unto this week.

The latest charges against the MDC leader arose after he allegedly called for mass protest marches aimed at overthrowing the Mugabe Government.

In opposing bail, the chief law officer Mr. Morgen Nemadire said the opposition leader had a propensity for committing similar offences. The defense had in its application raised arguments on elements, which it said constituted a crime.

However, Mr. Nemadire said violence or revolutionary means were not necessarily the only factors which resulted in the commission of treason. Treason, argued Mr. Nemadire could be committed peacefully and by overt actions with hostile intent, which he said was an unlawful change of Government. He said the offence could also be committed by merely inciting, contemplating, and postulating unlawful change of Government. []
